So many people get into trouble because they put sensitive, confidential, or incriminating items in writing. This could be a handwritten document or a typed document, which includes emails and text messages. This could also be a photo or video, which includes any and all social media content—yes, even Snapchat! Not everything disappears after 10 seconds!

If you need to communicate with someone, consider a face-to-face meeting, a telephone call, or even a Facetime session. Although the fact that you actually had the communication may be discoverable (e.g. phone records), the contents of the communication probably would not be discoverable—unlike a written document, photo, or video. So, if you need to communicate something confidentially, consider the medium that you are choosing to communicate that confidential message.
